Terms of Service

1. Acceptance of Terms

By accessing or using the Revalidator mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Revalidator is a continuing professional development (CPD) tracking application designed for UK healthcare professionals, particularly nurses, to help them meet NMC revalidation requirements. The Service includes:

• Voice-powered and manual CPD activity logging
• Data storage and organization
• Analytics and reporting tools
• Export functionality for NMC submission
• Mobile applications for iOS and Android

3. Eligibility

You must be:

• At least 18 years of age
• A healthcare professional or someone tracking CPD hours
• Capable of forming a binding contract under UK law

By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

4.1 Creating an Account

To use the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for maintaining the security of your account. Revalidator.uk cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

5. Payment and Pricing

5.1 Payment

The Service operates on a subscription basis. Your first month costs £2 (GBP), after which you will be charged £4.99/month. Alternatively, you can choose our annual subscription at £45/year (saving 25%). All subscriptions include full access to the Service and all future updates.

5.2 Refunds and Cancellation

Due to the low cost and immediate access to the full Service, we do not offer refunds except where required by law. You may cancel your subscription at any time, and you will continue to have access until the end of your current billing period.

5.3 Price Changes

We reserve the right to change our pricing for new users at any time. If you have an active subscription, we will provide at least 30 days' notice before any price increase affects your account, and you will have the option to cancel before the new pricing takes effect.

6. User Conduct

You agree NOT to:

• Use the Service for any unlawful purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or harmful code
• Collect or harvest information about other users
• Use the Service to spam or send unsolicited communications
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Create multiple accounts to circumvent restrictions
• Submit false or fraudulent CPD records

7. Your Content and Data

7.1 Ownership

You retain all ownership rights to the CPD records and data you enter into the Service ("Your Content"). We do not claim ownership of Your Content.

7.2 License to Us

By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete your account or remove the content.

7.3 Responsibility for Content

You are solely responsible for Your Content and the consequences of posting or publishing it. You represent that:

• You own or have the necessary rights to Your Content
• Your Content does not violate any laws or third-party rights
• Your Content is accurate to the best of your knowledge

7.4 Accuracy of CPD Records

While Revalidator helps you track CPD hours, you are ultimately responsible for ensuring the accuracy of your records for NMC submission. We provide tools to assist, but we cannot guarantee that your records meet all NMC requirements.

8. Intellectual Property

8.1 Our Rights

The Service, including its design, features, functionality, graphics, and user interface, is owned by Revalidator.uk and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Service
• Sell, rent, lease, or sublicense the Service
• Remove or alter any copyright, trademark, or proprietary notices

9. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our privacy practices as described in the Privacy Policy.

10. Service Availability

10.1 Uptime

We strive to provide reliable, uninterrupted service. However, we do not guarantee that the Service will always be available, error-free, or secure. The Service may be subject to limitations, delays, and other issues inherent in internet and electronic communications.

10.2 Maintenance

We may perform maintenance, updates, or improvements that temporarily interrupt or limit the Service. We will attempt to provide notice when possible, but we are not required to do so.

10.3 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

11. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third-party services. Your use of third-party services is at your own risk and subject to their terms and policies.

12. Disclaimers and Limitations of Liability

12.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Professional Advice

Revalidator is a tool to help you track CPD hours. It does not constitute professional advice regarding NMC revalidation requirements. You are responsible for ensuring your CPD activities and submissions meet NMC standards.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVALIDATOR.UK SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruption or data loss
• Any damages arising from your use or inability to use the Service

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Revalidator.uk and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content

14. Termination

14.1 By You

You may terminate your account at any time by contacting us at support@revalidator.uk or using the in-app account deletion feature. Upon termination, your data will be deleted in accordance with our Privacy Policy.

14.2 By Us

We may suspend or terminate your account if:

• You breach these Terms
• We are required to do so by law
• Your account has been inactive for an extended period
• We cease providing the Service (with reasonable notice)

14.3 Effect of Termination

Upon termination:

• Your right to access and use the Service immediately ceases
• We will delete your account and data as described in our Privacy Policy
• You may export your data before deletion if you initiate termination
• Provisions that by their nature should survive termination will continue (e.g., disclaimers, limitations of liability)

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

15.2 Disputes

Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 Informal Resolution

Before initiating any legal proceedings, you agree to first contact us at support@revalidator.uk to attempt to resolve the dispute informally.

16. General Provisions

16.1 Entire Agreement

These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Revalidator.uk regarding the Service.

16.2 Amendments

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

16.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

16.5 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

16.6 No Agency

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Revalidator.uk.
